What “ANE S.A.E.B.” responds to the Ministry of Development’s fine

Announcement issued by the frozen company “ANOS SA” in response to yesterday’s Ministry of Development for infringement of Article 54 of Law 5045/29-07-2023 on the limitation of unfair profitability phenomena. In response from 4.3.2024 Press Release of the Ministry of Development on the imposition of a fine of EUR 742,000 for alleged infringement of Article 54 of Law 5045/29.7. 2023 on the limitation of unfair profitability and for the purposes of informing the consumer, the company shall disclose the following: 1. According to the provision of Article 54 of Law 5045/2023 ‘… it is prohibited to deduct gross profit from the sale of any product necessary for the health, nutrition, living, movement, heating, production of hot water and consumer safety, as well as from the sale of school items and agricultural products and foodstuffs, in particular raw materials for the production of fertilisers, feed, raw cereals of all kinds, flour, sunflower vegetable oils, when the gross profit margin per unit exceeds the respective gross profit margin per unit before 31 December 2021’. 2. As part of the audit the company collaborated with the Ministry of Development’s Interservice Market Control Unit and a total of 78 product codes were checked for 28 of which were deemed to have been complied with and no fine was imposed. 3. For 50 product codes it was considered that during the controlled period from 02.10.2023 to 31.10.2023 the company allegedly showed a greater profit margin than the same period of 2021. Therefore, ‘ANE SA’ declares CATEGORIES without prejudice to any legal right that: 1. the audit report of the Ministry of Development’s Interservice Market Control Unit is full of errors and inaccuracies, as the cost of production of the products has not been taken into account in calculating the gross profit margin, which for these products is calculated on a quarterly basis. 2. she has never obtained, in an illegal or unfair manner, profits from making her products available to the consumer. 3. intends to appeal to the administrative courts for the annulment of the fine decision and for the restoration of its corporate reputation.
