(Title) After investigating the complaint lodged by the Association of Cardio-Heavy pnefmonopathon and Transplant Association and Friends of Heart Transplantation “Continue” on the Onassis Cardiac Surgery Center, the Ombudsman proceeded to a finding which has sent Secretary of Health and Welfare.
According to the complaint lodged by the two bodies “during the period July-August 2009, the Onassis Cardiac Surgery Center rejected the heart and lung transplants five donors” because failure transplant team setting the summer vacation ».
As stated in finding of the Ombudsman” A part of the Onassis Cardiac Surgery, which has become the heart transplant unit, lung, unique in Greece and Cyprus, was on leave from July 13 to August 14, 2009. Since it could not be established transplant team decided not to take cuttings, resulting in the loss to Greece at least two cases of heart and lung transplants at the expense of the health or life of suitable potential recipients who were registered in the list of Onassis.
also added that “the Onassis violated one of the obligations, commitments associated with the granting final authorization to a transplant unit: the ready availability of organs for the group making the assessment at any time and receive transplants available».
The Ombudsman notes that “the claim of the Onassis not disturbed by the continuous monitoring of transplanted and transplant patients are not exempt from the obligation to have a constant readiness group and a group receiving organ transplants.
also noted that “the administrative investigation conducted by the Executive Director of the Onassis was looking at the decision to take cuttings off the summer vacation. Pointed end to the conclusion that “the National Transplant Organization did to further investigate the failures of the Onassis transplant unit during the relevant period, but merely asked to send written notices regarding the cause of the rejection of transplants. Especially for this case, the Ombudsman asked the Minister for Health and Social Solidarity M. Xenogiannakopoulou to investigate circumstances that led to the failure of the transplant unit Onassis and ensure the uninterrupted operation of the unit at all levels and during holiday periods ».
Also, the Ombudsman, in response to the complaint, proposed :
1. To specialize the jurisdiction of the EOM to oversee the operation of the Transplant Unit in accordance with N.2737/1999. In this context, to ensure the required written justification from the Transplant Units of rejecting grafts available for making and monitoring the observance.
2. To formalize and fully activated by a coordinating and facilitator of the Minister of Health and Welfare’s role both EOM in strict compliance with the specified obligations.
3. To strengthen the institutional contact the Ministry of Health-EOM and activate the control mechanisms of the ministry to ensure the effective investigation of problems arising in the functioning of the Transplant Unit.
