The Ombudsman of the Citizen Mr. Andreas Pottakis stated that, for the Independent Authority, the transparency of administrative action and responsibilities, where they exist, for the very dead wreck of Pylos is an elementary judicial request, inextricably linked to respect for the rule of law, as is the thorough investigation by the administration of any other incident associated with an infringement of the right to life, health and physical integrity. The Advocate recalled the principles of the case-law of the European Court of Human Rights (ECHR), which, in the case of the wreck of Pharmaconesia 2, pointed out that the authorities “did not take, within the framework of their powers, the measures which could be considered, reasonably, capable of preventing risk.” The primary issue at the European Court of Justice in a search and rescue operation is whether the efforts of the authorities “have focused adequately and appropriately on the life” of the persons involved.”
