39-year old Benjamin Kerr. He and another man in the wagon, the 24-year-old Sam Pierce, they were asleep as the hour was past midnight. At some point of the route, the Kerr suddenly woke up and thinking that the train has reached the terminal he woke up and the passenger so as not to lose the attitude.
When Pierce stood up from his seat he realized that he had “panicked” free as the 39-year-old had woken up at the wrong stop. This fact angered the young man who in a state of mania he searched through the train for Kerr, which he found and was badly beaten. In fact, since he broke his nose, threw him out of the car with the kicks.
All of this was recorded on the security cameras of the train and the footage used in the trial, which was done with considerable delay. The judges heard the defendant in his apologia by saying that “he wanted to punish the Kerr because it made him look like a fool”. The court punished eventually Pierce to a year in prison for the cruel attack that unleashed to the passenger.
