The proposed amendment modifies Article 1350 of the Civil Code concerning family law. According to this change, same-sex male couples will not have the right to parenthood via surrogate mothers. This move also halts any potential judicial acceptance of such applications. Last year, laws regarding same-sex marriages prohibited child acquisition through surrogacy, but conflicting court rulings followed. The new provision clarifies that ‘the inability to carry a pregnancy due to gender does not constitute medical infertility.’ Minister George Florida explained that the interpretative clause was introduced following recent court decisions, affirming that ‘men do not have the capability to carry a pregnancy.’ The ministry aims to prevent Greece from becoming a hub for surrogacy trafficking. In addition to these measures, the package includes other important legal amendments, such as eliminating statutes of limitations for ministerial offenses and enhancing digital justice systems.
