The European Commission has opened a formal antitrust investigation into French pharmaceutical giant Sanofi over suspected anti-competitive practices in the influenza vaccine market.
Suspected Disparagement Campaign
Sanofi is under scrutiny for allegedly abusing its dominant market position by running a misleading campaign to discredit Fluad, an influenza vaccine developed by Australian company CSL Seqirus — a direct competitor to Sanofi’s own Efluelda.
According to the Commission’s statement, cited by the Athens News Agency (ANA), regulators suspect Sanofi presented Fluad as clinically inferior to Efluelda, despite national vaccination guidelines in several EU member states recommending Fluad for specific patient groups.
Targeted Outreach and Denial
The campaign reportedly targeted healthcare professionals primarily in Germany and France. In response to the probe, Sanofi denied any wrongdoing in a statement to AFP, affirming it acted — and continues to act — fully in compliance with all applicable laws and regulations, including EU competition rules.
“Sanofi believes it has acted and continues to act in full compliance with all applicable laws and regulations, including competition law,” said a company spokesperson.
The Commission emphasized that launching a formal investigation is a procedural step and does not prejudge the outcome. Sanofi reiterated its commitment to fair competition and ensuring patient access to innovative vaccines.
Potential Consequences
If the Commission confirms the allegations, it could impose fines on Sanofi for abuse of dominance. As part of the process, Sanofi may propose binding commitments to address the Commission’s concerns and resolve the case without a formal finding of infringement.
