For the second time, the New Building Code (NOК) has come before Greece’s Council of State — this time before its Plenary Session. Six municipalities in Attica — Alimos, Kifissia, Filothei–Psychiko, Amarousio, Varkiza–Voula–Vouliagmeni — along with environmental and cultural associations and dozens of Attica residents, have filed an appeal seeking the annulment of Presidential Decree 94/2025.
The decree, titled ‘Procedure for Approving Special Urban Environmental Compensation Schemes to offset incentives granted under the New Building Code and other details regarding the issuance of building permits,’ was issued following the Council of State’s Plenary decisions 146–149/2025, which mandated specific amendments to the NOК.
The appellants argue that the new regulatory framework is unconstitutional, violates the right to property, and contradicts the European Convention on Human Rights. The Technical Chamber of Greece and a private engineering firm also submitted interventions in support of the appeal.
A decision from the Council of State’s Plenary Session is expected in the coming weeks.
